App Terms of Use (Beta)
Last updated: October 17, 2026. These terms apply during the beta period, which runs through December 31, 2026, and will be replaced before the app’s general launch.
1. Who we are and what these terms cover. Flackable, LLC, a Pennsylvania limited liability company (“Flackable,” “we” or “us”), operates a public relations and content agency (the “AGENCY”) and the Flackable app at portal.flackable.com (the “APP”). These terms govern your use of the APP only. The AGENCY’s website terms are at flackable.com/terms, and the services the AGENCY provides to a client are governed by that client’s service agreement. If these terms and a service agreement conflict about the services, the service agreement controls. These terms control use of the APP.
2. Beta. The APP is in beta. Features may change, pause or be removed, and some may show as “Coming soon” for your account. We do not promise uninterrupted availability. We keep backups, but you should keep your own copies of anything important, and you can export your records with the APP’s export tools at any time. AI features have daily usage limits. We will tell you about significant changes when we reasonably can, usually inside the APP.
3. Access and accounts. Access is by invitation. You sign in with a Google or X account; we never see or store that password. Your organization’s administrator or your PR team assigns your role, and roles decide what you can see and do. You are responsible for activity under your sign-in and for telling your administrator or us when a person’s access should end. We may suspend or remove access to protect the APP, other users or the law.
4. Your content. Your organization owns the content it and its people enter or upload, such as coverage records, requests, drafts, notes, logos, headshots and bios (“Your Content”). You give Flackable permission to host, store, process, display and transmit Your Content, including through the service providers named in the App Privacy Policy, to operate the APP and provide services to your organization. You confirm you have the rights needed for what you upload. Content your organization chooses to make public through a press page, media kit, Newsline or the experts directory is public. Turning a press page public is your organization’s consent for Flackable to feature that public coverage; turning the page private withdraws it.
5. Our content. The APP, its design, software and documentation, and the credibility marketing playbook material in it belong to Flackable or its licensors. You may use them only through the APP and for your organization’s own purposes. You may not copy, resell, reverse engineer or build a competing product from them.
6. AI features and Robin. The APP includes AI features, including an AI coordinator named Robin that is always labeled as AI. AI output is a suggestion, not a fact. Your PR team reviews Robin’s proposals before anything changes, and you should verify facts, quotes, dates and links before relying on any AI-generated text. AI features use a third-party model provider described in the App Privacy Policy. You may use AI output created for your organization for your organization’s purposes. We make no promise about its accuracy, originality or fitness for a purpose.
7. Email. The APP sends email on behalf of your PR team, such as coverage alerts, monthly reports and account notices. You can turn notification emails off in your profile; account notices still send. The APP never emails journalists. If your organization copies Robin’s address on an email, that message is handled as the App Privacy Policy describes.
8. Acceptable use. Do not upload content you have no right to use or that is unlawful, defamatory or deceptive; try to reach another organization’s data or any part of the APP you were not given; probe, overload, scrape or disrupt the APP; circumvent usage limits or access controls; share embargoed material beyond its terms; or use AI features to produce content meant to mislead. We may remove content or access that breaks these rules.
9. Third-party services. The APP relies on services we do not control, including Google and X for sign-in, an email delivery provider, cloud hosting and an AI model provider. Their terms govern their services. Flackable is not affiliated with or endorsed by Google, X, Postmark or SpaceXAI. Links from the APP to outside sites are for convenience; we are not responsible for those sites.
10. Ending access. Your organization can ask us to remove a person’s access at any time, and we can end access or the beta, with notice when we reasonably can. After access ends, your organization may ask us within 30 days for a copy of its records, and we will provide it in a common format.
11. Disclaimers. The APP is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. Beta software has bugs.
12. Limitation of liability. To the fullest extent permitted by law, Flackable is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from the APP, under any legal theory. Our total liability for claims relating to the APP in any 12-month period will not exceed the greater of $100 or the amount your organization paid us for access to the APP in that period. Where the law does not allow these limits, our liability is limited to the extent the law allows.
13. Your responsibility for Your Content. You are responsible for Your Content and for your organization’s use of the APP. If a third party makes a claim against Flackable because of Your Content or your misuse of the APP, you agree to cooperate with us and to cover the reasonable costs that result, to the extent the law allows.
14. Feedback. If you send us suggestions, we may use them without obligation to you.
15. Changes to these terms. We may update these terms. The date at the top shows the last revision. For significant changes we will show a notice in the APP and ask you to accept the new terms at your next sign-in.
16. Governing law. Pennsylvania law governs these terms, without regard to conflict-of-law rules. Disputes will be brought exclusively in the state or federal courts located in Berks County, Pennsylvania.
